What we have here is a constitutional requirement of realization, a requirement that there be, in an absolute manner, a DETERMINATION

 consisted only in specifying a general concept, supposedly derived from constitutional norms, and within it a certain "play of the scene" took place. Obviously, such a play must be eliminated as soon as a serious perspective of normative adequacy and application appears on the horizon. For the same reason, it is recognized that contingency, contradiction and the play of appearances have their own domain, in the institutional arrangement, let us say with Hegel, they have their "right", but as long as, at the same time, it is self-limiting and does not intend, under any circumstances, to give such contradictions and arbitrariness the rigorous identity of law. What we have here is a constitutional requirement of realization, a requirement that there be, in an absolute manner, a DETERMINATION. And formal certainty belongs to this determination. ''The greatest enemy of good is the best'' constitutes the expression of truly healthy human common sense against the vanity of false reasoning and reflections in politics, when the latter dangerously insinuates itself against the foundations of due process of law, intending to give ''legal forms'' to the subjective impressions of private interests.
